Distance Sales Agreement

This agreement has been drawn up for sales made over the internet in accordance with the provisions of the "Regulation on the Application Procedures and Principles of Distance Contracts" published in the Official Gazette dated 13.06.2003 and numbered 25137.
ARTICLE 1 – SUBJECT
The subject of the contract is the delivery of the goods/products sold by the SELLER to the BUYER, the qualities and sales price of which are stated below, and the determination of the rights and obligations of the parties within the scope of the legislation regulated by the Consumer Protection Law No. 4077.
ARTICLE 2 – PARTY INFORMATION

2.2 – BUYER INFORMATION
- Member of www.foodry.com.tr
- The address and contact information entered during membership is taken into account.
ARTICLE 3 – PRODUCT INFORMATION SUBJECT TO THE CONTRACT
The type of products, quantity, brand/model, color, number, sales price, payment method, etc. are determined by the information at the time of ordering.
ARTICLE 4 – GENERAL PROVISIONS
- 4.1 – The BUYER declares by confirming electronically that he/she has read the basic characteristics, price, payment and delivery conditions of the product.
- 4.2 – Delivery is made within the legal 30 days, according to the delivery condition depending on the BUYER's address; this period may be extended by a maximum of 10 days, provided that prior notice is given.
- 4.3 – In case of delivery to another person/organization, FOODRY cannot be held responsible in cases where the deliverer refuses to accept the delivery.
- 4.4 – FOODRY is responsible for delivering the product intact, complete and in accordance with the order conditions.
- 4.5 – For delivery, the signed contract copy must reach FOODRY and the price must be paid. Otherwise, the delivery obligation will be eliminated.
- 4.6 – If payment is not made for a product delivered to the BUYER due to malicious use of the card, the product will be sent to FOODRY by the BUYER within 3 days; the shipping costs will be covered by the BUYER.
- 4.7 – If delivery cannot be made due to force majeure, weather conditions or transportation disruptions, FOODRY is obligated to notify the BUYER. In this case, the BUYER:
- You can cancel the order,
- You can have it replaced with a similar product,
- May request postponement of delivery.
- 4.8 – When defective products under warranty are sent for repair, shipping costs are covered by FOODRY.
- 4.9 – The contract becomes valid when it is signed by the BUYER and delivered to FOODRY by fax or mail.
ARTICLE 5 – RIGHT OF WITHDRAWAL
The BUYER may exercise his/her right of withdrawal without giving any reason within 7 days from the date of receipt of the product. In order to exercise this right:
- Notifying FOODRY by fax, e-mail or telephone,
- The product must be unused and its packaging must be intact,
- The cargo delivery report and the original invoice must be returned along with the product.
The refund will be made within 15 days of receipt of these documents. If the original invoice is not sent, no VAT refund will be made. In case of withdrawal, the shipping cost is the responsibility of the BUYER.
Products for which the right of withdrawal cannot be exercised:
- Disposable products,
- Copyable software/programs,
- Fast-deteriorating products or expired products,
- Consumables such as DVDs, VCDs, CDs, cassettes, batteries, toner; the content packaging of these products must be unopened and unused.
- Products that are produced or personalized according to the specific wishes of the consumer.
In payments made by credit card or similar payment tools, the BUYER may object to unauthorized use of the card; the card issuing organization will refund the amount within 15 business days following the objection.
Within the scope of this contract, Consumer Arbitration Committees and the courts of the consumer's place of residence are authorized.
